Terms of Service
Version 2026-08-terms-3 · Effective 2026-08-17
The terms governing your use of Clause50, including plan/trial terms and acceptable use.
Who you're contracting with
Data controller: B N Atre, trading as Clause50
Address: Bangalore, Karnataka, India — PIN 560017
Country of establishment: India
Privacy contact: admin@clause50.com
A sole proprietorship has no legal personality separate from its owner — the controller named above is the natural person, not a company.
The service
Clause50 ingests metadata, logs, and traces about your AI systems and generates versioned, hash-chained, auditor-ready EU AI Act evidence artifacts. Clause50 generates and maintains compliance evidence. It is a documentation tool, not legal advice, and does not by itself make any system compliant. Signing the EU Code of Practice on Transparency of AI-Generated Content (for Art. 50(2)/(4)) remains a separate, free option; Clause50 helps you evidence it. Verify obligations against the primary regulation or your counsel.
Eligibility
You must be able to form a binding contract under the law that applies to you, and you confirm you are not acting on behalf of a minor. If you are accepting these terms for an organisation, you confirm you have authority to bind that organisation.
Plans and trial
New accounts include a free trial period, described on our pricing page. The statutory 14-day consumer right of withdrawal is a separate right and is described unambiguously on Refunds & Cancellation — do not assume the two run on the same clock or mean the same thing.
Payment and merchant of record
Paid plans and evidence packs are billed through Polar Software, Inc., acting as our payment processor and merchant of record. Polar is the legal seller for the purchase: it charges your payment method, issues the invoice/receipt, and its Buyer Terms (shown at checkout) govern the sale itself. These Terms of Service govern your use of Clause50; they do not, and cannot, override or contradict Polar's own terms as the seller of record.
Acceptable use
- Do not use the service for any unlawful purpose, or to store data you do not have the right to hold.
- Do not attempt to circumvent tenant isolation, rate limits, or the entitlement/gating controls.
- Do not attempt to reverse engineer, decompile, or disassemble the service, except where this is permitted by mandatory law.
- Do not scrape, resell, sublicense, or provide third-party access to the service without our written permission.
- Do not use the service, or any output generated through it, for benchmarking against a competing product without our written permission.
- You are responsible for the accuracy and lawfulness of whatever you submit into your AI System Record.
Feedback
If you send us feedback, bug reports, or suggestions, you grant us a royalty-free, worldwide, perpetual licence to use them to improve Clause50, without any obligation to credit or compensate you. Sending feedback is always optional.
Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from: (a) the data, logs, or other content you submit into your AI System Record or otherwise upload to the service; (b) your breach of these terms, including the Acceptable use section; or (c) your violation of any law or a third party's rights in connection with your use of the service. This does not limit any liability that cannot be excluded under applicable law.
Suspension and termination for cause
We may suspend your access immediately, without notice, if we reasonably believe this is necessary to protect the security or integrity of the service or other customers, or if you materially breach the Acceptable use section. For any other material breach of these terms, we will give you notice and a reasonable opportunity (at least 7 days) to cure it before suspending or terminating your access.
Suspension or termination for cause moves your organisation to the same read-only state, and follows the same 6-month retention and deletion timeline, described under “What happens to your evidence after cancellation” in Refunds & Cancellation: artifacts you have already generated remain downloadable and independently verifiable, and only forward-looking work — generating new artifacts, connector syncs, drift alerts — stops. You may terminate your own account at any time by cancelling, as described on that page.
Disclaimer
Clause50 generates and maintains compliance evidence. It is a documentation tool, not legal advice, and does not by itself make any system compliant. Signing the EU Code of Practice on Transparency of AI-Generated Content (for Art. 50(2)/(4)) remains a separate, free option; Clause50 helps you evidence it. Verify obligations against the primary regulation or your counsel.
Liability
To the maximum extent permitted by law, Clause50 is provided on an “as is” basis and we disclaim liability for indirect, incidental, or consequential damages arising from your use of the service. Nothing in these terms limits liability that cannot be excluded under applicable law, including consumer-protection law that may apply to you.
Governing law
These terms are governed by the laws of India, and the courts of Bengaluru, Karnataka have exclusive jurisdiction — without prejudice to any mandatory consumer-protection rights you hold as an EU/EEA customer, and without limiting our obligations under the GDPR. This is our current starting position and may be refined as the business grows.
Changes to these terms
We will update the version and effective date above whenever these terms change materially.
Miscellaneous
- If any clause of these terms is held unenforceable, the rest remain in force.
- Our failure to enforce a right under these terms is not a waiver of that right.
- You may not assign these terms without our written consent; we may assign them in connection with a reorganisation, merger, or sale of the business.
- These terms, together with the Privacy Policy and Data Processing Agreement, are the entire agreement between you and us regarding your use of the service, and supersede any prior representations on the same subject.
